(1) The Government of Nepal, in the event of an economic and monetary crisis in the country and a crisis of foreign exchange, by publishing a notice in the Nepal Gazette, orders the Nepali citizens who are rich in foreign exchange to transfer the foreign exchange they own as follows. Can give:-
(a) The person to whom the foreign exchange is specified in the said notification shall deposit or cause to be sold in the name of the Government of Nepal to the bank or to the person authorized by the bank for that purpose at the rate determined by the bank.
(b) The person who has the right to grant the right to receive the foreign exchange specified in that notice to the Government of Nepal should transfer such right to the name of the Government of Nepal by taking the price from the bank at the prescribed rate. But the Government of Nepal may, by the same notification or by issuing another order, make the said order inapplicable in relation to a particular person or a particular class of persons.
(2) This section shall not be applicable in relation to foreign exchange held by a person for the purpose of any business with the permission of the bank obtained from the licensed person.
